1. Agreement to Terms
By accessing or using the Open Bed website, booking a consultation, or engaging with any of our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
These Terms apply to all visitors, users, community members, and anyone who accesses or uses services provided by Open Bed, based in Portland, Oregon.
2. Description of Services
Open Bed provides the following services:
Adult Family Home (AFH) Licensing Consulting — Guidance and advisory support for individuals and organizations pursuing AFH licensure in the state of Oregon.
Discovery Calls — 30-minute video consultations with a licensed consulting partner to assess your AFH licensing needs and readiness.
Community Membership — Access to the Open Bed Oregon Community, including educational resources, networking, and founding member benefits.
Educational Content — Resources, guides, and materials related to AFH licensing processes, compliance, and operations in Oregon.
Our services are informational and advisory in nature. We do not provide legal, medical, or financial advice. Always consult a licensed attorney or appropriate professional for legal matters.
3. Eligibility
By using our services, you represent that:
You are at least 18 years of age
You have the legal authority to enter into this agreement
You will use our services in compliance with all applicable laws and regulations
The information you provide to us is accurate and complete
4. Booking & Consultation Policy
a. Scheduling
Discovery Calls and consultations must be booked through our official scheduling system. You will receive a confirmation upon booking.
b. Cancellations & Rescheduling
Cancellations or rescheduling requests must be made at least 24 hours before your scheduled appointment.
Late cancellations or no-shows may result in forfeiture of your session fee or deposit, if applicable.
c. Consultant Availability
Consulting sessions are available Monday through Friday, 9:00 AM – 5:00 PM ET. Availability is subject to change. We will notify you of any scheduling conflicts as soon as reasonably possible.
d. Nature of Advice
Consulting sessions provide general guidance based on publicly available Oregon AFH licensing information and the consultant's professional experience. Outcomes are not guaranteed. Open Bed is not responsible for decisions made based on consulting advice.
5. Community Membership
a. Founding Membership
Founding member status is granted to qualifying individuals who join the Open Bed Oregon Community during the founding period. Benefits, terms, and pricing are subject to the membership agreement provided at enrollment.
b. Conduct
Members of the Open Bed Community agree to:
Treat all members and staff with respect
Not share proprietary community materials outside of the platform
Refrain from spam, harassment, or inappropriate content
Comply with all community guidelines posted within the platform
c. Termination of Membership
We reserve the right to suspend or terminate membership for any user who violates these Terms or community guidelines, without refund of prepaid fees.
6. Payments & Fees
a. Pricing
Service fees are listed on our website or communicated prior to booking. Prices are subject to change with reasonable notice.
b. Payment Processing
All payments are processed securely through our third-party payment processor. We do not store your full credit card information on our servers.
c. Refund Policy
Refund requests must be submitted within 7 days of purchase for unused services.
Completed consultations are non-refundable.
Founding membership fees are non-refundable unless otherwise stated at the time of enrollment.
We reserve the right to evaluate refund requests on a case-by-case basis.
7. Intellectual Property
All content on the Open Bed website and within the Open Bed Community — including but not limited to text, graphics, logos, guides, worksheets, and course materials — is the exclusive property of Open Bed and is protected by applicable copyright and intellectual property laws.
You may not:
Copy, reproduce, distribute, or republish our content without written permission
Use our materials for commercial purposes without authorization
Remove or alter any copyright or proprietary notices
8. Disclaimers
a. No Guarantees
Open Bed does not guarantee that use of our services will result in AFH licensure approval, certification, or any specific business outcome.
b. "As Is" Basis
Our website and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
c. Third-Party Links
We may link to third-party websites or resources. We are not responsible for the content, accuracy, or practices of any third-party sites.
9. Limitation of Liability
To the fullest extent permitted by Oregon and applicable federal law, Open Bed, its owners, consultants, employees, and affiliates shall not be liable for:
Any indirect, incidental, special, or consequential damages
Loss of revenue, profits, data, or business opportunities
Damages resulting from reliance on consulting advice or community content
Service interruptions or technical failures
Our total liability to you for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim in the 90 days prior to the claim.
10. Indemnification
You agree to indemnify and hold harmless Open Bed and its consultants, partners, and staff from any claims, losses, liabilities, damages, or expenses (including reasonable attorney's fees) arising from:
Your use of our services
Your violation of these Terms
Your violation of any third-party rights
Any misrepresentation made by you
11. Privacy

12. Governing Law & Dispute Resolution
These Terms shall be governed by the laws of the State of Oregon, without regard to its conflict of law provisions.
a. Informal Resolution
Before filing any formal dispute, you agree to contact us first and attempt to resolve the matter informally within 30 days.
b. Binding Arbitration
If informal resolution fails, disputes shall be resolved through binding arbitration in Portland, Oregon, in accordance with the rules of the American Arbitration Association (AAA), except where prohibited by law.
c. Class Action Waiver
You waive any right to participate in a class action lawsuit or class-wide arbitration against Open Bed.
13. Modifications to Terms
We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
14. Termination
We reserve the right to suspend or terminate your access to our services at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
